1.1 Introduction

These Terms of Service ("Terms") govern your access to and use of Awatif's structural analysis and design software platform (the "Service"), including any associated APIs, documentation, and reports. By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1.2 Definitions

"Service" means the web-based structural analysis and design platform, including all tools for second-order nonlinear analysis, reinforced concrete element design, and any related functionality.

"User" means any individual or entity that accesses or uses the Service.

"Output" means any analysis results, design calculations, reports, or other data generated by the Service.

"Eurocode" means the European Standards (EN) for structural design, including but not limited to EN 1992 (Eurocode 2) for concrete structures.

1.3 Eligibility and Professional Responsibility

The Service is intended for use by qualified structural engineers, engineering firms, and professionals with appropriate technical training and professional registration. By using the Service, you represent and warrant that:

  • You are a qualified professional or are working under the direct supervision of a qualified professional.
  • You understand that the Service is a computational aid and does not replace professional engineering judgment.
  • You accept full professional responsibility for any designs, calculations, or decisions informed by the Output.
  • You will independently verify all Output before relying on it for any design, construction, or certification purpose.

1.4 Scope and Nature of the Service

The Service provides second-order nonlinear frame analysis and reinforced concrete element design calculations in accordance with Eurocode specifications. The Service is intended as a complement to, and not a replacement for, simplified linear methods and professional engineering judgment.

The Service does not constitute engineering advice, professional consultation, or a certified design. No Output produced by the Service should be treated as a final design without independent verification by a competent professional engineer.

1.5 Account and Access

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You agree to notify us immediately of any unauthorized access. We reserve the right to suspend or terminate accounts that violate these Terms.

1.6 Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of applicable engineering codes and standards.
  • Reverse engineer, decompile, or attempt to extract the source code of the Service.
  • Share your account credentials or allow unauthorized third parties to access the Service.
  • Misrepresent Output as independently certified or as a substitute for professional engineering review.
  • Introduce malicious code or attempt to interfere with the Service's operation.

1.7 Intellectual Property

All rights, title, and interest in the Service, including its algorithms, interface, documentation, and underlying technology, remain the exclusive property of Awatif. Your use of the Service does not grant you any ownership rights.

You retain ownership of any project data, input parameters, and models you create using the Service. You grant us a limited license to process this data solely for the purpose of providing the Service to you.

1.8 Payment Terms

Fees for the Service are as stated on our pricing page. All fees are exclusive of applicable taxes. We reserve the right to change pricing with 30 days' notice. Failure to pay may result in suspension of access.

1.9 Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, COMPLETENESS, OR NON-INFRINGEMENT.

Without limiting the foregoing, we do not warrant that:

  • The Output will be accurate, complete, or suitable for any particular structural design application.
  • The Service will comply with all applicable versions and national annexes of the Eurocodes in every jurisdiction.
  • The Service will be uninterrupted, error-free, or free of defects.
  • The Service accounts for all loading conditions, material properties, construction tolerances, or site-specific factors relevant to any particular project.

1.10 Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

  • Awatif shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, business opportunities, or goodwill, arising out of or related to your use of the Service or any Output.
  • Awatif's total aggregate liability for all claims arising from or related to the Service shall not exceed the total amount you have paid to Awatif in the twelve (12) months preceding the claim.
  • In no event shall Awatif be liable for any structural failure, property damage, personal injury, or death arising from reliance on the Output, whether or not we were advised of the possibility of such damages.

You acknowledge that the limitations above reflect a reasonable allocation of risk and are a fundamental basis of the bargain between you and Awatif.

1.11 Indemnification

You agree to indemnify, defend, and hold harmless Awatif, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from: (a) your use of the Service; (b) any design, construction, or engineering decision based on the Output; (c) your violation of these Terms; or (d) your violation of any applicable law or regulation.

1.12 Termination

Either party may terminate these Terms at any time. Upon termination, your right to access the Service ceases immediately. We may retain your data for a reasonable period as required by law or for legitimate business purposes. Sections on Disclaimers, Limitation of Liability, Indemnification, and Governing Law survive termination.

1.13 Governing Law and Disputes

These Terms are governed by the laws of the Netherlands. Any disputes shall be resolved in the courts of Amsterdam, the Netherlands, unless the parties agree to alternative dispute resolution.

1.14 Modifications

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance. If you do not agree with updated Terms, you must stop using the Service.
